Does a rental contract have to be registered?

 

The landlord is required to register the rental contract within 2 months of signing at the registry office. As long as the rental contract has not been registered, the renter may terminate the rental contract at any time without notice and without the payment of any compensation. Registration also protects the landlord in the event of a third party dispute.

What is an inventory of fittings and fixtures?

 

This is a detailed, written description of the condition of the property. The new law makes it compulsory for the tenant and landlord to compile an inventory of fittings and fixtures.

 

  • At the beginning of the rental
    An inventory of fittings and fixtures must be compiled and signed at the beginning of the rental period. The tenant and landlord must both be present. Whatever is not included in the inventory of fittings and fixtures is considered to be in good condition. Write down the meter readings for water, gas and electricity as well.
  • At the end of the rental
    Before the new tenant moves in, the tenant and landlord draw up a new inventory of fittings and fixtures. Any defect mentioned in the new inventory of fittings and fixtures but not in the original one is considered to have taken place during the previous rental period. The renter is not obliged to pay for normal wear unless explicitly stipulated in the rental contract.
